1.1. The terms defined in this section shall have the meanings set forth herein:

1.2. "Agreement" refers to these Terms, as amended from time to time;

1.3. "Content" means any content, trademarks, text, images, video, audio, sound recordings, stream, videos synchronised with sound recordings and other audiovisual works, and the musical works embodied within sound recordings and music videos, written public comments, information, data, photographs, software, scripts, graphics, and interactive features generated, or other multimedia content or other information or material provided, or otherwise made accessible through the website or browser extension;

1.4. "Creator" means an OnlyFans content creator as defined in OnlyFans Terms of Use for Creators policy;

1.5. "TopCreator" means the services that we provide through the website and browser extension by Subscription and any related products, services, or applications;

1.6. "User" means any person who gets access or uses TopCreator;

1.7. "Agency" refers to any entity or individual who has registered at TopCreator and is authorised to manage the OnlyFans accounts of Creators through TopCreator;

1.8. "OnlyFans" means online subscription services for the purpose of allowing individuals to subscribe and access content uploaded by members of the service for sporting, fitness, and entertainment purposes. For more information about OnlyFans, please see their Terms of Service;

1.9. "Subscription" means getting access to TopCreator by periodically charged payments;

1.10. "Website" or "website" means a set of web pages available on the Internet via HTTP/HTTPS protocols with the domain name “topcreator.com”, without limitation of hierarchy levels;

1.11. "You" or "you" means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual(s) is accessing or using the Service, as applicable.

2.1. By using TopCreator, you agree not to engage in any activity that interferes with or disrupts the operation of TopCreator;

2.2. You shall not use TopCreator in any manner that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable;

2.3. You shall not upload, post, email, transmit, or otherwise make available any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party;

2.4. You shall not attempt to gain unauthorized access to TopCreator, other accounts, computer systems, or networks connected to TopCreator through hacking, password mining, or any other means.

3.1. To access TopCreator, you must create an account and become a subscriber by providing accurate and complete registration information. You shall keep your account password secure and confidential;

3.2. TopCreator reserves the right to refuse access to the Service to anyone for any reason at any time;

3.3. You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4.1. You may use TopCreator only for lawful purposes and in accordance with these Terms;

4.2. You agree to comply with all applicable laws, rules, and regulations in connection with your use of TopCreator;

4.3. You agree not to use TopCreator to engage in any conduct that restricts or inhibits anyone's use or enjoyment of TopCreator.

5.1. You retain ownership of any content you upload or otherwise make available on TopCreator;

5.2. By submitting content to TopCreator, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the content in connection with TopCreator;

5.3. You represent and warrant that you have all the rights necessary to grant the licenses granted in this section and that your content does not violate the rights of any third party.

6.1. You agree to indemnify and hold harmless TopCreator, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of TopCreator;

6.2. This indemnification obligation will survive the termination of these Terms and your use of TopCreator.

7.1. TopCreator is provided "as is" and "as available" without any representations or warranties of any kind, whether express or implied;

7.2. We do not warrant that TopCreator will be uninterrupted or error-free, or that any defects in TopCreator will be corrected;

7.3. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8.1. In no event shall TopCreator, its affiliates, or their respective officers, directors, employees, or agents be liable for any indirect, consequential, special, incidental, or punitive damages arising out of or in connection with your use of TopCreator;

8.2. Our total liability to you for all claims arising out of or in connection with these Terms or your use of TopCreator shall not exceed the amount paid by you, if any, to TopCreator in the six months preceding the event giving rise to the liability.

9.1. We will cooperate with law enforcement authorities as required by law;

9.2. We reserve the right to report any illegal activity to law enforcement authorities.

10.1. Our collection and use of your personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference;

10.2. By using TopCreator, you consent to the collection and use of your personal data as described in our Privacy Policy.

11.1. TopCreator may offer an affiliate program. Participation in the affiliate program is subject to separate terms and conditions.

12.1. These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles;

12.2. Any dispute arising out of or relating to these Terms or your use of TopCreator shall be resolved exclusively by the state or federal courts located in Delaware.

13.1. We may terminate or suspend your access to TopCreator immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms;

13.2. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
